A federal judge has ruled that the Department of Homeland Security (DHS) "likely violated" a U.S. citizen's First Amendment rights when immigration officials delivered a warning notice after he sent a critical email to the head of Immigration and Customs Enforcement (ICE), granting preliminary relief while the lawsuit moves forward. In a 43-page opinion issued Tuesday, Judge Rudolph Contreras of the U.S. District Court for the District of Columbia found that plaintiff David Streever was likely to succeed on his claim that ICE officials improperly threatened him over constitutionally protected political speech.
The judge concluded that a warning notice delivered to Streever's home could reasonably be interpreted as demanding that he stop criticizing ICE leadership and warning him of potential prosecution if he continued. Streever has a right to express his political views through non-threatening speech, however degrading the speech might be," Contreras wrote. The judge said the notice likely infringed on that right by threatening consequences if he did not stop criticizing government officials.
DHS argued that the warning was simply a reminder not to violate federal law and that the investigation into the email had already been closed. The government also maintained that ICE has a legitimate interest in investigating potential threats against officials, citing a significant increase in threats directed at agency personnel. Newsweek has contacted the man's legal team and DHS for comment via email outside office hours and is awaiting responses.
The ruling stems from a lawsuit filed by Streever, a U.S. citizen from New York, who challenged ICE's response to an email he sent on January 26 to then-Acting ICE Director Todd Lyons. In the email, Streever condemned Lyons over ICE's handling of the killings of Renee Good and Alex Pretti in Minnesota, calling him a "monstrous human being" and comparing him to a Nazi. The email did not contain any threat of physical violence, the court previously found.
"You are a monstrous human being and will go down in history as America's Reinhard Heydrich, the butcher," the email read. "The way you are protecting the obvious execution in Minnesota, even as we see the videos, will lead to your downfall. Even Trump will turn on you before the end, and you will be a sad, despised man who eats himself alive with shame at your own pathetic weakness.
"You will never know peace. You will seek to lose yourself, to escape the burden of knowing the truth about yourself. But wherever you go, you will find yourself.
