Experts say those questions could ultimately shape the case far more than the preliminary hearing itself.
Prosecutors have evidence they say supports a politically motivated targeting of the Turning Point USA co-founder, but veteran defense attorney Peter S. Christiansen says gaps remain that defense lawyers are likely to attack as the case develops. If the case proceeds to trial, it's likely that some of its biggest mysteries will be answered.
But right now, the biggest unanswered questions in the case, according to experts, are the motive and whether the shooting endangered people other than Kirk. Robinson is the Utah man charged with killing Kirk during a public event in September 2025. Prosecutors have alleged that the shooting was deliberate and politically motivated, pointing to evidence including an engraved shell casing and messages they say reflected hostility toward Kirk.
Defense lawyers, however, have challenged aspects of the state's theory and argued that important elements of the prosecution's case remain unproven. The defendant has been the focus of a months-long investigation that included searches of his residence, electronic devices and personal belongings. One question that has emerged throughout the proceedings is whether investigators found clear evidence explaining why Kirk was allegedly targeted.
While prosecutors have presented evidence suggesting political animus, public records do not indicate that investigators uncovered a detailed manifesto or evidence of long-term planning directed specifically at Kirk. "The biggest unanswered question is motive," former prosecutor John W. "The prosecution may have a mountain of evidence pointing to Robinson, but that does not necessarily explain why this happened, why Charlie Kirk was targeted or why it happened at that particular time." Brett Rosen, a criminal defense attorney, told Newsweek that establishing whether Kirk's killing was a targeted political act or an isolated decision is a "key issue" in the case.
