A North Dakota mother accused of killing two of her young children and seriously injuring a third remains in custody on a $3 million cash bond as she awaits a preliminary hearing scheduled for October 6. Kailey Renae Erhart, 22, has been charged in Morton County District Court with two counts of murder and several additional offenses in connection with the alleged August 6 attack at her family's home in Mandan. A 3-year-old and a 5-month-old child died, while a 1-year-old injured during the incident is expected to make a full physical recovery, according to an update shared by family members.
The case has generated significant online attention, with some social media users comparing it to the prosecutions of Massachusetts mother Lindsay Clancy and North Carolina mother Andrea Faust. Both of those cases involved questions about mental health and criminal responsibility. Erhart's criminal case remains in its early stages.
She has not entered a plea, and no mental health or insanity defense has been publicly presented in court. Newsweek has contacted the Morton County State's Attorney's Office and the Mandan Police Department for comment. Erhart, a 22-year-old Mandan resident, was arrested on August 6 after police responded to reports that a mother had attacked her children inside a home at 1205 South Frontier Trail.
Police said in a statement that they responded around 5:40 p.m. During a news conference, Mandan Police Chief Jason Ziegler said initial information given by dispatchers "was that the mother had locked herself inside the home with three children and was going to kill them." A court affidavit, described by Valley News Live and other local outlets, alleged that officers discovered three children with severe neck injuries inside a bedroom. Authorities said a 5-month-old child died the night of the incident, while a 3-year-old child died the following day.
Family members have since said in an update posted to a public fundraiser that the surviving 1-year-old's surgery was successful and doctors expect a full physical recovery. "Colton is recovering in the hospital, his surgery went well, and doctors expect a full physical recovery from this attack," the family wrote. Ziegler said at the news conference that the scene was "something that nobody should ever have to see in their lifetime." According to court records, Erhart faces two counts of murder, one count of attempted murder, three counts of aggravated assault, two counts of terrorizing with a dangerous weapon and one misdemeanor count of domestic violence resulting in bodily injury.
In the probable-cause affidavit, as reported by local media, investigators alleged the incident began before police arrived, when Erhart threatened the children's father while armed with a handgun and holding one of the children. The affidavit further alleged that the father was able to take the firearm, disassemble it and scatter its components throughout the home. The affidavit, reports said, described cellphone video obtained by investigators in which Erhart could be heard telling the children's father, "Say goodbye to your kids." Erhart then allegedly chased the children's father and grandmother from the residence with a knife before locking them outside, prompting a 911 call.
